§ 3-3. Consumption on county property.

  • (a)

    It is unlawful for any person to consume any alcoholic beverages on any county-owned property or county parks, except as specifically exempted in this section.

    (b)

    The provisions of subsection (a) shall not apply to The Clayton and Mildred Revels Senior Center, under lease to The Council on Aging of Clay County, Florida, located at 604 Walnut Street, Green Cove Springs, Florida, provided that the following conditions are met:

    (1)

    The Council on Aging of Clay County, Florida is in compliance with the terms contained in its lease with the county;

    (2)

    Any function shall be by invitation only, organized by the user of the county property for the benefit of the user's invited guests and/or participants, and cannot be open to the general public;

    (3)

    The consumption of alcoholic beverages will be limited to the inside of the premises only and shall not be allowed outside of the building;

    (4)

    The hours during which alcoholic beverages may be consumed shall be in compliance with subsection 3-2(b) of the Clay County Code;

    (5)

    If alcoholic beverages are provided, served, or consumed, the function must include a food service;

    (6)

    Alcoholic beverages may not be served at any function for more than three (3) hours;

    (7)

    Section 3-4 concerning permits does not apply; and

    (8)

    The Council on Aging of Clay County, Florida shall be responsible to ensure that the requirements of this article are followed.

    (c)

    The provisions of subsection (a) shall not apply to the fairgrounds on State Road 16 in Clay County, Florida, provided that the following conditions are met:

    (1)

    A user agreement is entered into with the county;

    (2)

    A permit is obtained in accordance with the permit requirements set forth in section 3-4 below;

    (3)

    The user shall be responsible to ensure that the requirements of this article, specifically including the provisions of sections 3-4 through 3-7, and any permit requirements or conditions are followed.
