§ 7.5-5. Administration; enforcement.

  • (a)

    Upon a determination by the county engineer or the county code enforcement officer that any excavation, cut, dredge or fill of land has commenced or occurred in Clay County without compliance with this chapter, the county engineer is authorized to issue an immediate cease and desist order, which shall be served upon the owner of the land affected according to the most recent property tax roll and upon any other party known to be responsible for the activity.

    (b)

    The continued excavation, cut, dredge or fill of land after receipt of a cease and desist order shall be a misdemeanor, punishable as provided by general Florida law.

    (c)

    Following the issuance of the cease and desist order, the county engineer shall promptly forward a report of the activity to the appropriate state and federal environmental regulatory agencies.

    (d)

    The county engineer may withdraw any cease and desist order upon full compliance with the provisions of this chapter.
