Chapter 7.1. EMERGENCY MANAGEMENT |
Article I. DECLARATION OF EMERGENCY |
§ 7.1-7. Authority of the board.
(a)
The board when sitting in regular or special session shall have the reserved power and authority by resolution to:
(1)
Declare, extend or terminate a state of local emergency;
(2)
Alter, extend or terminate a state of local emergency declared by executive order under section 7.1-5;
(3)
Revoke or suspend any of the powers and authority provided under section 7.1-6 for the duration of all or part of a state of local emergency declared by executive order under section 7.1-5;
(4)
Alter or supersede the exercise of any of the powers and authority provided under section 7.1-6 for the duration of all or part of a state of local emergency declared by executive order under section 7.1-5; or
(5)
Authorize the county manager, subject to the limitations of section 7.1-10, to determine after a major disaster or catastrophic disaster if the removal of disaster-generated debris accumulated within the county is necessary in order to remove or reduce threats to life, public health, and safety. Upon making such determination, the county manager shall inform the board's chairman and shall immediately implement the disaster-generated debris removal management plan set forth in section 7.1-10.
(b)
During any state of local emergency declared by executive order under section 7.1-5 or by the board under subsection (a)(1), the board when sitting in regular or special session may exercise by resolution the power and authority specified in section 7.1-6, with or without the recommendation of the EMD or the county manager.
(c)
Nothing in this article shall be construed to limit such power and the authority of the board set forth in subsections (a) and (b).
