§ 6-190. Service, publication and posting of notice.
The provisions of this section apply to each notice issued under section 6-185, section 6-186, section 6-187, section 6-188 and section 6-189.
(a)
The building official on the date of the notice shall:
(1)
Cause the notice and any attachments thereto to be served upon the owner of the building or structure identified therein and each affected party with respect thereto personally or by certified mail, postage prepaid and return receipt requested;
(2)
If mailed, cause the notice to be addressed and sent to the address of the recipient as reflected on the tax roll for the mailing of tax notices, or if not so reflected, the address of the recipient as reflected in the instrument in the public records of the county by which the interest of the recipient in the property appears; and,
(3)
Cause a copy of the notice and any attachments thereto to be posted on the premises upon which the building or structure is located in a conspicuous location.
(b)
If an address of the owner of the building or structure identified therein or of an affected party with respect thereto is not available, or if a notice mailed under subsection (a) is returned undelivered, the building official shall:
(1)
Cause the notice to be published once a week for four (4) consecutive weeks in a newspaper of general circulation within the county;
(2)
Cause the notice and any attachments thereto to be served upon the person whose address was unavailable or whose notice was returned undelivered by certified mail, postage prepaid and return receipt requested, and addressed to the address of the building or structure identified in the notice;
(3)
Cause a copy of the notice and any attachments thereto to be posted in a conspicuous place at the administration building of the county in the county seat; and,
(4)
Cause a copy of the notice and any attachments thereto to be posted on the county's website.
(c)
The failure of any person upon whom a notice is served in accordance with this section to receive such notice shall not invalidate any proceedings or actions under this article.
(d)
Personal service of a notice shall be deemed effective upon the date of service.
(e)
Service of a notice by mail in accordance with subsection (a) or (b) shall be deemed effective upon the date mailed.
(f)
Service of a notice by publication in accordance with subsection (b) shall be deemed effective upon the last date of publication.
