§ 2-28. Members.

  • (a)

    Through June 30, 2007, the historical commission shall be composed of fifteen (15) members appointed by the board of county commissioners with three (3) members serving on the historical commission residing in each county commission district; provided, commencing December 1, 1999, the number of historical commission members required to reside in each county commission district shall be reduced to two (2). On or before said date, the board of county commissioners shall specifically designate the ten (10) then current historical commission members who shall be required to reside within a county commission district as well as the specific district within which each such member must reside. The terms of all fifteen (15) members shall expire at midnight on June 30, 2007.

    (b)

    On and after July 1, 2007, the historical commission shall be composed of eleven (11) members appointed by the board of county commissioners, with five (5) of the members designated as residency members. One (1) residency member must be appointed from each of the five (5) single-member county commission districts. The remaining six (6) historical commission members shall be referred to in this section as at-large members.

    (c)

    The initial terms of historical commission members appointed under subsection (b) shall expire as follows:

    (1)

    The terms of the residency member from County Commission District 1 and of one (1) of the at-large members shall expire at midnight on June 30, 2008;

    (2)

    The terms of the residency member from County Commission District 2 and of one (1) of the at-large members shall expire at midnight on June 30, 2009;

    (3)

    The terms of the residency member from County Commission District 3 and of two (2) of the at-large members shall expire at midnight on June 30, 2010;

    (4)

    The terms of the residency member from County Commission District 4 and of one (1) of the at-large members shall expire at midnight on June 30, 2011;

    (5)

    The terms of the residency member from County Commission District 5 and of one (1) of the at-large members shall expire at midnight on June 30, 2012.

    (d)

    Upon the expiration of a historical commission member's initial term as provided in subsection (c), the succeeding term for each reappointed or newly appointed member shall commence and continue for a duration of five (5) years; provided, the term of any historical commission member appointed to fill the unexpired term of another member shall be for the balance thereof.

    (e)

    The board of county commissioners may appoint up to five (5) alternate members of the historical commission, with no more than one (1) such alternate member designated as residing in each single-member county commission district, and each being referred to in this section as an alternate residency member. The provisions of subsection (d) to the contrary notwithstanding, each alternate residency member shall serve for a term of five (5) years, except the initial term of each alternate residency member shall expire at midnight on December 31, 2003. The term of any alternate residency member appointed to fill the unexpired term of another alternate residency member shall be for the balance thereof. Each alternate residency member shall be permitted to attend and participate in any historical commission meeting, but shall have no voting privileges at such meeting unless a residency member designated from the same single-member county commission district as such alternate residency member is designated is absent from such meeting. No alternate residency member shall count toward the quorum at any historical commission meeting unless said alternate residency member is eligible to vote at such meeting.

    (f)

    The failure on the part of any historical commission member, whether a residency member, an alternate residency member or an at-large member, to attend three (3) consecutive regular meetings of the historical commission, may constitute grounds for such member's removal from the historical commission by the board of county commissioners. The chairman of the historical commission is required to notify the chairman of the board of county commissioners in writing immediately following the third such meeting with respect to such historical commission member. Upon receipt of such notification, the chairman shall cause the matter to be placed before the board of county commissioners for consideration and action during the next succeeding regular meeting of the board.

    (g)

    Subject to the provisions of subsection (i), each residency member and each alternate residency member must reside and continue to reside within the single-member county commission district from which the member was designated throughout the member's term.

    (h)

    Should it be determined by the board of county commissioners that a residency member or an alternate residency member resides outside the boundaries of the single-member county commission district from which said member was designated, then immediately upon such determination said member shall be deemed removed from the historical commission.

    (i)

    The provisions of subsection (h) shall not apply to any residency member or alternate residency member who no longer resides within the boundaries of the single-member county commission district from which said member was designated because of a change in said boundaries pursuant to Chapter 124, Florida Statutes, for so long as said member continues to reside within the former district boundaries.

    (j)

    Subject to the provisions of subsection (l), each at-large member must reside and continue to reside within the county throughout the at-large member's term; provided, no more than three (3) at-large members may reside in any one (1) single-member county commission district at any one (1) time.

    (k)

    Should it be determined by the board of county commissioners that more than three (3) at-large members reside in any one (1) single-member county commission district at any one (1) time, then immediately upon such determination:

    (1)

    In the case of four (4) at-large members residing in the same district, the at-large member who most recently commenced residence within such district shall be deemed removed from the historical commission; or,

    (2)

    In the case of five (5) at-large members residing in the same district, the two (2) at-large members who most recently commenced residence within such district shall be deemed removed from the historical commission.

    (l)

    The provisions of subsection (k) shall not apply to any at-large member if as a direct result of a change in single-member county commission district boundaries pursuant to Chapter 124, Florida Statutes, said member has become the fourth or fifth at-large member to reside in the same district for so long as said member continues to maintain the same residence.

    (m)

    Should it be determined by the board of county commissioners that an at-large member resides outside the county, then immediately upon such determination said member shall be deemed removed from the historical commission.

    (n)

    Members of the historical commission shall serve without compensation.
