§ 2-9. Initiative petition forms.
(a)
Definitions. As used in this section and unless the context clearly requires otherwise, the following terms and phrases shall have the meanings herein ascribed:
(1)
Board shall mean the county's board of county commissioners.
(2)
Charter shall mean the Clay County Home Rule Charter.
(3)
County shall mean Clay County, Florida.
(4)
Legislative format shall mean the style of presenting legislative enactments whereby all additions to the codification of such enactments are shown as underlined and all deletions are shown as stricken through.
(5)
Supervisor shall mean the county's supervisor of elections.
(b)
Findings. The board hereby makes and adopts the following findings in support of the establishment of this section:
(1)
The charter provides for mechanisms and procedures whereby the county's electors may petition for the placement of initiative referenda on the ballot proposing amendments to the charter and proposing the enactment of county ordinances.
(2)
The charter does not prescribe the forms which the petitions should take, but provides for an ordinance or ordinances to be enacted to prescribe the style and requirements of the petition forms to be used.
(3)
The board desires to implement the provisions of the charter by establishing the style and requirements of such forms that allow for ease of utility by the county's electors.
(4)
The forms set forth in this section have been reviewed by the supervisor and meet the ministerial requirements of the supervisor's office.
(c)
Short Title. This section shall become known and may be cited as the "Initiative Petition Forms Ordinance."
(d)
Petition Forms.
(1)
The style and requirements of the petition form which shall be used for proposing amendments to the charter by the initiative process pursuant to section 4.2.A(3) of the charter are as follows:
PETITION TO AMEND
CLAY COUNTY HOME RULE CHARTERI am a registered voter of Clay County and hereby petition the Board of County Commissioners of Clay County, Florida, to place substantially the following ballot title and summary relating to the text of the following proposed Charter amendment on the ballot in the next election available for such purpose pursuant to section 4.2.A of the Clay County Home Rule Charter after final verification of the full number of signatures necessary by the Supervisor of Elections.
A.

Text: (The full text of the charter amendment shall be inserted here in legislative format. The hierarchy of subdivisions used throughout the charter, from highest to lowest, begins with articles, which are designated by upper case Roman numerals; followed by sections, which are designated by two Arabic numbers separated by a period punctuation mark; followed by subsections, which are designated by upper case alphabetic letters; followed by paragraphs, which are designated by Arabic numbers in parentheses; followed by subparagraphs, which are designated by lower case alphabetic letters in parentheses. If the charter amendment proposes the creation of a new section or the amendment of an existing section that lacks subdivisions, the entirety of the section, including its caption, must be set forth. If the charter amendment proposes the creation of a new paragraph or the amendment of an existing paragraph that lacks subdivisions, the entirety of the paragraph, including its designation and caption, as well as the designation and caption of the paragraph's subsection, must be set forth. The text of the paragraph's subsection need not be included. If the charter amendment proposes the creation of a new subparagraph or the amendment of an existing subparagraph, the entirety of the subparagraph's paragraph, including its designation and caption, as well as the designation and caption of the paragraph's subsection, must be set forth. A complete and legible printed name as registered, signature as registered, address and date of signature, and either date of birth or voter registration number are mandatory requirements for each signature. All entries made on the form shall be in ink or other permanent substance; entries shall not be made in pencil. No signature block can appear on a page that lacks any other part of the petition.)

I am a registered voter of Clay County and hereby petition, pursuant to section 2.2.1 of the Clay County Home Rule Charter, the Board of County Commissioners of Clay County to enact the ordinance on file with the Supervisor of Elections for Clay County or amend or repeal an existing ordinance of Clay County as detailed in a proposed ordinance on file with the Supervisor of Elections for Clay County, said new, amending or repealing ordinance relating to the following subject matter.
A.
Title: (Insert the title of the proposed ordinance, said title conforming with the requirements of Section 125.67, Florida Statutes, or its successor provision.)

If the board of county commissioners does not enact the ordinance after a sufficient number of electors have signed the petition, then I petition the board of county commissioners to call a referendum election on the proposed ordinance in accordance with section 2.2.1 of the Clay County Home Rule Charter.
(3)
The parenthetical directions in each of the forms provided in paragraphs (1) and (2) of this subsection are mandatory requirements in the preparation and execution of the form, unless otherwise specifically indicated, whereby failure to comply with any such mandatory requirement shall disqualify the particular signature from verification by the supervisor.
(4)
Only a single font may be used throughout the petition. Petition fonts are limited to Arial Regular, Calibri Regular, Courier New, and Times New Roman. Font sizes must be no smaller than 10 points throughout the petition.
(5)
Except as otherwise provided herein, all petition page margins shall be no less than one inch.
(6)
If the petition consists of multiple pages, then the following rules shall apply:
a.
Each page must be sequentially numbered in the center of the bottom no closer to the bottom edge of the page than one-half inch using Arabic numbers in "Page X of Y" format, where X is the page number and Y is the number of pages in the petition.
b.
The ballot title appearing on the first page must be set out at the top of each succeeding page, and a straight line across the width of the page within the left and right margins must appear at least one-half inch below such ballot title. The petition continuation text must commence at least one-half inch below such line.
(e)
Signature Verification. The supervisor shall verify signatures in accordance with any applicable provisions of general or special law and, subject to any specific requirements hereof, with any applicable rules, regulations or opinions of the Division of Elections of the Florida Department of State.
