§ 2-2. Discretionary surfees of sheriff.
(a)
The county sheriff shall charge a discretional surfee for the services listed in paragraphs (a), (b), (c), and (d) of Section 30.231, Florida Statutes, in addition to the amount permitted under Section 30.231, Florida Statutes, according to the following schedule:
(1)
For all summons or writs except subpoenas and executions: Four dollars and fifty cents ($4.50) for each person or respondent to be served.
(2)
For all writs except executions requiring a levy or seizure of property, two dollars ($2.00) in addition to the extra four dollars and fifty cents ($4.50) surfee as stated in paragraph (1).
(3)
For witness subpoenas, two dollars ($2.00) for each witness to be served.
(4)
For executions as follows:
a.
Two dollars ($2.00) for docketing and indexing each writ of execution, regardless of the number of persons involved;
b.
Five dollars ($5.00) for each levy;
c.
One dollar ($1.00) for advertisement of sale under process;
d.
Three dollars ($3.00) for deed or bill of sale.
(b)
After levy the sheriff shall be entitled to collect said fees, notwithstanding payment of debt to plaintiff, and shall be allowed actual expenses for the levying, safekeeping, and sale of property under levy.
(c)
All fees collected under paragraphs (1), (2), (3), and (4) of subsection (a) shall be nonrefundable, and no additional fees shall be required for alias and pluries documents when service was not affected on the original document.
(d)
All fees collected under the provisions of subsection (a) shall be paid monthly into the fine and forfeiture fund of the county.
(e)
All of the discretionary surfaces authorized in this ordinance shall be subject to the provisions of Chapter 77-234, Laws of Florida [F.S. §§ 30.232, 125.0166].
