§ 16-110. Review requirements.

  • This article and the impact fee study shall be reviewed by the commission at least every three (3) years. The initial and each review thereafter shall consider new estimates of population and other socioeconomic data, changes in construction, land acquisition and related costs, and adjustments to the assumptions, conclusions or findings set forth in the impact fee study adopted by section 16-84. Each review shall additionally consider changes in right-of-way acquisition and related costs and changes in trip generation rates, external trip lengths and traffic volume counts. The purpose of this review is to evaluate and revise, if necessary, the road impact fees to ensure that they do not exceed the reasonably anticipated costs associated with the capital improvements and additions necessary to offset the demand generated by the road impact construction on the county road system. In the event the review of the article required by this section alters or changes the assumptions, conclusions and findings of the impact fee study adopted by reference in section 16-84, or alters or changes the amount or classification of the road impact fee, the impact fee study adopted by reference in section 16-84 shall be amended and updated to reflect the assumptions, conclusions and findings of such reviews and section 16-84 shall be amended to adopt by reference such updated studies.
