§ 16-3. Sidewalk fund.

  • An applicant may request the county to approve a payment to the county in lieu of constructing a required sidewalk/pedestrian facility. The payment shall be made into the Clay County Sidewalk Fund. The county may use this fund to construct sidewalks/pedestrian facilities which are located in the same geographic area or community in the county as the particular sidewalk the applicant would have been required to construct (Fleming Island, Clay Hill, Keystone, Kingsley Lake, Greater Green Cove Springs, Greater Orange Park, Branan Field, Lake Asbury, Middleburg, Drs. Inlet, etc.). The timing, method, placement and decision to construct said facility shall be in the county's sole discretion.

    The amount of money to be paid by the applicant to the county shall be determined by the county engineer after the applicant has submitted final construction plans and cost estimates prepared by a licensed contractor for the required facility and appurtenances. The amount shall be equal to the anticipated cost to construct at the time of the applicant's request as proposed on the approved plans. The payment to the county in lieu of the construction shall be made prior to the issuance of any building permit.
