§ 13-52. Definitions.

  • The following words and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context otherwise requires:

    Board of county commissioners means the board of county commissioners of Clay County, Florida.

    Clerk means the clerk of the circuit and county courts of Clay County, Florida.

    County means Clay County, Florida.

    Crosswalk:

    (1)

    That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway, measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway.

    (2)

    Any portion of a roadway or intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface.

    Designated public parking space means any public parking space marked in accordance with and conforming to the minimum requirements of Sections 316.1955 and 316.1956, Florida Statutes.

    Fire lane means any area adjacent to a structure, whether said area is on public or private property, which has been designated by the chief fire official of Clay County, Florida, as a fire lane pursuant to the Standard Fire Protection Code of 1988 as adopted by the board of county commissioners and as amended from time to time, and which is clearly marked as such.

    Handicapped person means any person who is:

    (1)

    Severely physically disabled and has permanent mobility problems which substantially impair his/her ability to ambulate; or

    (2)

    Certified as legally blind, and who has been issued an exemption entitlement parking permit pursuant to Section 320.0848, Florida Statutes.

    Intersection.

    (1)

    The area embraced within the prolongation or connection of the lateral curblines; or, if none, then the lateral boundary lines of the roadways of two (2) highways which join one another at, or approximately at, right angles; or the area within which vehicles traveling upon different highways joining at any other angle might come in conflict.

    (2)

    Where the highway includes two (2) roadways thirty (30) feet or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes two (2) roadways thirty (30) feet or more apart, then every crossing of two (2) roadways of such highways shall be regarded as a separate intersection.

    Official traffic-control device means all signs, signals, markings and devices placed or erected by authority of a public body or official having jurisdiction for the purpose of regulating, warning or guiding traffic.

    Official traffic-control signal means any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and permitted to proceed.

    Owner means a person who holds the legal title of a vehicle, or, in the event a vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, or in the event a mortgagor of the vehicle is entitled to possession, then such conditional vendee, or lessee, or mortgagor shall be deemed the owner, for purposes of this article.

    Park or parking means the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading of merchandise or passengers as may be permitted by law under this article.

    Parking enforcement specialist means a person appointed by the sheriff to enforce parking regulations who has successfully completed a training program established and approved by the police standards and training commission for parking enforcement specialist, but who does not otherwise meet the uniform minimum standards established by the police standards and training commissioner for police officers or auxiliary or part-time officers under Section 943.12, Florida Statutes.

    Parking ticket means the official form used by the sheriff to notify the owner of a vehicle that said vehicle is parked, stopped or standing in violation of the terms of this article.

    Person means any natural person, firm, copartnership, association or corporation.

    Private road or driveway means any privately owned way or place for vehicular travel by the owner and not open to travel by the public.

    Public parking space means any parking space which the owner, lessee or person in control of such property provides for use by members of the public other than employees of such owner, lessee or person, including, but not limited to, parking spaces at shopping centers, stores, offices, motels, malls, restaurants and marinas.

    Railroad means a carrier of persons or property upon cars operated upon stationary rails.

    Roadway means that portion of a highway improved, designed, or ordinarily used for vehicular travel, exclusive of berm or shoulder. In the event a highway includes two (2) or more separate roadways, the term "roadway," as used herein, shall refer to any such roadway separately, but not to all such roadways collectively.

    Sheriff means the sheriff of Clay County, Florida or his duly appointed deputies.

    Sidewalk means that portion of a street between the curblines, or the lateral line, of a roadway and the adjacent property lines, intended for use by pedestrians.

    Stand or standing means the halting of a vehicle, whether occupied or not, otherwise than temporarily, for the purpose of, and while actually engaged in, receiving or discharging passengers, as may be permitted by law under this article.

    Stop or stopping means, when prohibited, any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid a conflict with other traffic or to comply with the directions of a law enforcement officer or traffic control sign or signal.

    Street or highway means the entire width between the boundary lines of every way or place of whatever nature when any part thereof is open to the use of the public for purposes of vehicular traffic.

    Traffic means pedestrians, ridden or herded animals, and vehicles, and other conveyances either singly or together while using any street or highway for the purposes of travel.

    Vehicle means any device, in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
