§ 12-22. Permit—Required; application.

  • (a)

    No transient merchant shall engage in any of the business regulated by this article without first obtaining a permit from the division. Permits shall be issued for a three-month period upon payment of a two hundred dollar ($200.00) application fee and filing an application stating or providing:

    (1)

    The name, age and permanent address of the applicant or, in the case of a business entity, the names, ages, and addresses of its principals and officers.

    (2)

    The type of permit desired and location of the business and the zoning of the proposed business location. Each permit application shall contain a letter of permission from the property owner, his authorized agent or other person with the legal right to authorize utilization of the property on which the permit holder intends to operate. This letter shall contain the name, address and telephone number of the property owner, his agent, or other legal authorized person; and the division staff shall confirm that permission was granted from the property owner, his agent or other legally authorized person prior to the issuance of any permit required by this section. In no case shall the director issue a permit to any location which is within five hundred (500) feet with respect to seasonal sales of Christmas trees, pumpkins and fireworks and within one thousand five hundred (1,500) feet with respect to all other products or services, of any established permanent business which sells the same type of products or services to be sold under the permit. The director may require the applicant to submit a drawing of the location of the requested permit site to indicate the surrounding businesses to confirm compliance with the distance restrictions required herein. The permit and a copy of the permission letter from the property owner, his agent or other legally authorized person, shall be conspicuously displayed by the permit holder at the permit location at all times.

    (3)

    A description of the merchandise offered for sale under the permit.

    (4)

    The applicant's federal tax identification number and state sales tax identification number.

    (5)

    A site plan depicting adequate motor vehicle access and off-street parking for purposes of public safety, as deemed reasonably necessary and appropriate by the director.

    (6)

    All temporary structures such as tents and canopies shall be shown on the site plan and shall meet all setback requirements for the zoning district in which the property is located. Permits shall be required for all temporary structures, including tents and canopies.

    (7)

    Such other information as is required by law and as the director deems reasonably necessary to enable the director to effectively enforce the applicable provisions of this article.

    (b)

    All sites for which permits have been issued shall be subject to inspection at all reasonable times by law enforcement, public safety, building code inspectors and code enforcement personnel of the county to ensure continued compliance with all applicable laws, codes and ordinances.
