§ 10-92. Changes in benefit unit boundaries.

(a)

Nothing in this article shall be construed to prohibit the adoption of a future ordinance changing the boundaries of the benefit unit.

(b)

The boundaries of the benefit unit may be expanded by the board, in its sole discretion, to include the incorporated area of any municipality within the county upon consent to such inclusion being adopted by an ordinance of such municipality and the provision of notice to the county not later than October 15 preceding the fiscal year in which assessments are to be imposed within such expanded boundaries. The boundaries of the benefit unit shall not be expanded unless any such municipal ordinance shall provide that the consent is (a) irrevocable for the entire period during which any obligations remain outstanding or (b) if no obligations are outstanding, irrevocable unless consent is subsequently withdrawn by the adoption of an ordinance of such municipality prior to June 1 preceding the next fiscal year.

(c)

The expansion or contraction of the benefit unit shall not invalidate any solid waste disposal assessment properly imposed hereunder; however, the board shall comply with the procedures set forth herein prior to imposing any solid waste disposal assessment against property not previously subject thereto.
