§ 301. Electricity.
The Board of County Commissioners of Clay County is hereby authorized to grant a nonexclusive franchise for a term of not more than thirty (30) years to, and collect payment of a fee therefor by, any publicly owned electric utility to construct, maintain, repair, operate, and remove lines, poles, and other electric power facilities within the unincorporated areas of Clay County under, on, over, across, and along any county highway, road, easement, right-of-way, or other public property of the county for the transmission, distribution, or sale of electricity. Any publicly owned electric utility to which a franchise shall be granted is hereby authorized to pay the franchise fee regardless of any right or privilege previously granted it by the legislature to operate in any county or counties without cost or obligation.
If any provision of this act or the application thereof to any person or circumstance is held invalid, the invalidity shall not affect other provisions or applications of the act which can be given effect without the invalid provision or application, and to this end the provisions of this act are declared severable.
