ORDINANCE 93-31

An Emergency Ordinance of the Board of County Commissioners of Clay County, Florida, Granting to the Jacksonville Electric Authority, Its Successors and Assigns, and Electric Utility Franchise; Imposing Provisions and Conditions Relative Thereto; Making Certain Findings and Declaring the Existence of an Emergency Based Thereon; Repealing Clay County Ordinances 79-17 and 91-2, and Providing an Effective Date.

RECITALS

Whereas, the Board of County Commissioners of Clay County, Florida, adopted Clay County Ordinance 79-17, as amended by Ordinance 91-2, by which it intended to grant an electric utility franchise to the Jacksonville Electric Authority in Clay County, Florida; and,

Whereas, although said Board and said Authority subsequent to the adoption of Ordinance 79-17 conducted themselves as provided thereunder, said Authority has raised the issue whether the original grant of franchise was formally accepted by it; and,

Whereas, said Board and said Authority desire to resolve this issue by the adoption hereof; and,

Whereas, the need to confirm the creation of the franchise is a matter of great public urgency, giving rise to an emergency within the meaning of Section 125.66(3), Florida Statutes, requiring the immediate adoption hereof without observing the regular ordinance adoption procedures set forth in Section 125.66, Florida Statutes.

Now Therefore Be It Ordained by the Board of County Commissioners of Clay County, Florida, that:
